By using the site https://gymnova.com (hereinafter the "Site"), the User accepts the present general conditions of use (hereinafter the "GCU"). These GCU govern the access and the use of this Site of which he declares to have taken knowledge.

Gymnova SAS (hereinafter the "Owner" of the Site) provides its users (hereinafter the "User", together with the Owner hereinafter the "Parties"), using the online store, with a customer code and a personal and confidential password allowing them to identify themselves and access the various services.

4. OUR RESPONSIBILITY

The Site Owner will do its best to ensure the availability of our services and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. We shall not be held responsible for any delay or inability on your part to meet your obligations under these GTUs if the delay or inability results from a cause beyond our reasonable control. This condition does not affect your legal right to have products shipped and services provided within a reasonable time or to receive a refund if the products or services ordered cannot be delivered within a reasonable time due to a cause beyond our reasonable control.

Nothing in these TOU is intended to limit or exclude our liability for fraud, or for death or personal injury caused by our negligence or gross negligence.

5. DISPUTES / APPLICABLE LAW

This contract is subject to French law both for the substantive rules and for the rules of form.
Any dispute relating to the execution or interpretation of these GCU will be subject to the jurisdiction of the Court according to the rules of common law.
Unless otherwise agreed in writing, all orders shall be governed by the general terms of sale and the present GTC of Gymnova SAS in force at the time.

6. MODIFICATION OF THE SERVICE OR THE GCU

We reserve the right to make modifications to our service, to our procedures, to our terms and conditions, including the present GTC at any time. You are subject to the terms and conditions, procedures and TOU in effect at the time you use the Site. If any provision of this TOU is deemed invalid, void, or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

7. WAIVER

If you breach this TOU and we take no action, we will still be entitled to use our rights and remedies in all other situations where you breach this TOU.
The failure of the other Party to enforce any of its obligations under the TOU shall not be construed as a waiver of such obligation in the future.
